In this section you will find the current and previous publication agreements and terms of use of the Goethe University Data Repository (GUDe).
You can read the respective version of the signed publication agreement in the detailed view of the metadata of your submissions in GUDe. If there is an alteration to the publication agreement between the publication/backup of different versions of your research data, the current versions at the time of submission apply.
In order to use GUDe, it is necessary to agree to the current terms of use. This is done the first time you log in to GUDe after the update and requires your active agreement.
Publication agreement¶

This agreement governs the storage and electronic publication of research data in the Goethe University Data Repository (GUDe) based on the FAIR criteria. The rights holders may make their research data available on a restricted or unrestricted basis (open access) at their own discretion.
GUDe is a service offered by Goethe University to its members and staff as well as collaborating scientists and is jointly implemented by the Johann Christian Senckenberg University Library (UB) and the University Computer Center (HRZ).
As an institutional repository, GUDe serves to implement the current Guidelines for Ensuring Good Scientific Practice of the German Research Foundation (DFG) and the current Research Data Management Policy of Goethe University.
Research data are collected, observed, simulated, derived or generated in the context of research and can be stored together with the accompanying metadata as digital objects in GUDe (hereinafter referred to as 'digital objects'). Submitted research data may also include the associated documentation (and software).
In GUDe, it is also possible to create public datasets without research data, for example for projects, institutions and persons, for better searchability and contextualization, and to link these to the research data (hereinafter referred to as 'datasets'). If both digital objects and datasets are meant in the following, the term 'submissions' is used.
1. Granting of rights¶
- The rights holder grants Goethe University the non-exclusive, royalty-free and irrevocable right, unlimited in space and time, to long-term storage their digital objects, to make them accessible via GUDe and to duplicate them for these purposes.
- When uploading, the rights holder personally decides whether the digital objects are stored and
i. can only be accessed by them personally for their own archiving purposes and can only be made accessible to a restricted group of users by them personally (access condition type: private) or
ii. made publicly accessible (with a time delay, if applicable) within the GUDe system under license conditions chosen by the rights holder, which determine the rights of use for any subsequent use (access condition type: public).
Delayed publication is achieved by imposing an embargo on the digital objects. Different license conditions can be selected in GUDe. - If the rights holder chooses to make the digital objects publicly accessible in accordance with 2. (ii), Goethe University is also granted the right to make the metadata of the digital objects available under a CC0 1.0 license. Furthermore, they grant Goethe University the right to make their digital objects accessible as part of national collection orders for online availability or for long-term archiving (e.g. by the German National Library), insofar as this does not conflict with express agreements with third parties (e.g. publishers).
- The rights to authorship and commercialization of the digital objects in other forms remain unaffected by (1) and (2).
- When creating datasets, the copyright holder grants Goethe University the right to make them available under a CC0 1.0 license.
- Goethe University is also granted the right, if necessary (e.g. for the purpose of long-term physical preservation or long-term archiving, improvement of accessibility, or for statistical analyses), to make technical changes to the digital objects and datasets (e.g. to convert them into other electronic and physical formats) and, if necessary, to transfer them to a successor system. This also includes the right to correct and/or complete the metadata entered by the rights holder. In doing so, Goethe University is entitled to use all appropriate technical means, formats and methods.
2. Obligations of the rights holders¶
- The rights holder is responsible for the selection, compilation and description (including metadata) of the research data as well as the quality check of the content of the submissions.
- The rights owners assure to only upload research data, logos and profile pictures, datasets free of harmful elements, especially computer viruses, worms, Trojans and spying mechanisms. Furthermore, they respect the licensing rights, personal rights and copyrights.
- The rights holder declare that the submission of their digital object does not violate any rights of third parties (e.g. co-authors, co-authors, publishers, third-party funders). In particular, no publisher or other third party (e.g. third-party funder) has an exclusive right of use up until this point.
- The rights holder assure that they are entitled to the necessary rights for the herein granted rights to the uploaded digital objects and that any co-authors or co-authors agree to this. If they use an auxiliary person for the upload, they are responsible for ensuring that this person has been duly instructed.
- Furthermore, it is hereby assured that in cases of doubt or if alleged or actual legal obstacles arise which prevent the implementation of this agreement, Goethe University shall be notified thereof without delay and * to the extent necessary * the access rights and license conditions shall be adjusted in an appropriate manner. If the legal obstacle or ambiguity cannot be removed, Goethe University may withdraw from the agreement. If the rights of third parties are infringed, the rights holder shall indemnify Goethe University against all regress claims by third parties. Goethe University may fulfill third-party claims directed against it (e.g. the claim for deletion of personal digital objects).
- GUDe may only be used for the storage and publication of digital objects and their contextualization with datasets. The rights holders ensure that submissions do not contain any illegal content, e.g. content that glorifies violence, incites hatred or defames public opinion.
3. Storage, accessibility and Blocking¶
- The digital objects are stored and kept accessible within the scope of organizational and technical capabilities in the uploaded form and/or in an appropriately edited form, in accordance with the terms of use.
- Goethe University reserves the right to refuse the storage and/or publication of submissions if there are reasonable grounds for doing so. These include, but are not limited to, reasonable doubt about the quality of the submission or the technical suitability of GUDe for storage and/or publication, reasonable doubt that the rights holder has the necessary rights, or reasonable belief that storage and/or publication would violate applicable laws.
- The release for publication of digital objects in GUDe is based on standards and recommendations (documentation standards) that are developed together with the faculties. Goethe University only sifts, checks and monitors the digital objects stored and published on the repository for obviously illegal content. There is no examination with regard to any actual legal situation, in particular with regard to protectability and rights ownership. Goethe University does not research on its own initiative circumstances that indicate illegal activities.
- The digital objects are assigned a unique and permanent address via unique persistent identifiers (currently DOI).
- After submission, the metadata entered can no longer be deleted, withdrawn, corrected or changed by the rights holder. For incorrect submissions, however, there is the possibility to request a correction for a part of the metadata. This will be treated as a new submission.
- After publication, digital objects can no longer be deleted, withdrawn, corrected or changed by the rights holder. However, it is possible to additionally submit a new updated version of the digital objects.
- The filed digital objects will be stored for at least ten years. No warranty is given beyond this period, and Goethe University is entitled but not obligated to delete digital objects after the ten-year period. However, the University will endeavor to retain the digital objects beyond the above period. In the event of deletion, the metadata of the digital object will be retained for the perpetual citation of the research data in GUDe.
- After the ten-year period has expired, the rights holder can only request the deletion of the research data, but not the metadata of the digital object.
- Goethe University is entitled to block access to submissions and/or delete them if there are concrete indications of an infringement of third party rights, without Goethe University being obliged to inform the rights holder.
- Goethe University observes, as far as possible, the recommendations of the professional community for the archiving of digital objects. Goethe University may use the assistance of third parties to fulfill its tasks.
- Goethe University endeavors to provide its members and staff with access to the digital objects they have stored and released for them, even after they have left the university. To this end, members and staff can voluntarily create a new account based on their ORCID-iD before leaving the university and transfer the reading rights they have already claimed to this account.
4. Data Protection¶
- The rights holder confirms that they have complied with the applicable data protection regulations for the collection and processing of the submissions and at the same time that they are authorized to store and, if necessary, publish the submissions in GUDe.
- The rights holder assures that the research data do not contain any other personal data (e.g. personal data of the research subject) in the sense of the applicable data protection regulations.
- GUDe and the rights holder are responsible for the respective processing themselves, there is no joint processing.
5. Legal Succession¶
- In the event of a legal succession regarding the delivered digital objects, the rights holder must inform Goethe University accordingly and name the successor.
- If, in particular in cases of the death or non-traceability of the whereabouts of the rights holder, the legal succession is no longer properly traceable, Goethe University is not obligated to make inquiries.
- Goethe University is authorized to transfer the rights of use granted by this agreement in whole or in part to third parties and to grant simple rights of use to other repositories or to commission a third party to make the digital objects accessible without requiring any separate consent from the copyright holder of the digital objects.
6. Liability¶
- Goethe University endeavors to provide all services diligently and in accordance with the currently available state of the art. However, it does not assume any further warranty or liability, in particular for the realization of certain functions of GUDe, the correctness, up-to-dateness or suitability for certain purposes of use of the digital objects.
- The use of the digital objects provided is at the sole risk of the user.
- Goethe University assumes no liability or warranty if digital objects, logos and profile pictures are downloaded illegally by third parties, modified or published elsewhere without consent or used in any other way.
7. Final Provisions¶
- This Agreement shall be governed by the laws of the Federal Republic of Germany, excluding the provisions of conflict of laws.
- Amendments and supplements to this agreement must be made in text form. This also applies to the waiver of the text form.
- The invalidity or unenforceability of individual provisions of this agreement shall not affect the validity of the remaining provisions of the agreement.

These Terms of Use govern the use as well as the rights and obligations of the registered users in the Goethe University Data Repository (GUDe).
The Goethe University Data Repository (GUDe) is the institutional repository of the Johann Wolfgang Goethe University Frankfurt (Goethe University) for its members and associates as well as cooperating scientists and is jointly implemented by the Johann Christian Senckenberg University Library (UB) and the University Computing Center (HRZ). Both institutions, in cooperation with the faculties of Goethe University, are responsible for the implementation of and compliance with these terms of use and the documentation standards.
GUDe provides a platform for storing and publishing research data based on the FAIR criteria. The rights holders can make their research data available in a restricted or unrestricted form (open access) at their own discretion. The selection, compilation and description (incl. metadata) of the research data as well as the quality control of the content are carried out exclusively by the rights holders.
In the following, research data with the accompanying metadata are referred to as digital objects, and public datasets without research data are referred to as datasets (for example, for projects, institutions, and individuals). If both digital objects and datasets are meant, the term 'submissions' is used.
1. Scope¶
- GUDe is a service for storing and publishing digital objects and datasets that can be used via a web browser and the Internet. Registered users can publish digital objects via GUDe in order, among other things, to provide clear proof of authorship for the scientific achievements and to enable the citability and findability of the digital objects.
- Storage in GUDe is not dependent on the research data already having been published or used as part of a publication. Publication in GUDe is optional and may be delayed. GUDe is not intended to be a repository for working copies of data that are used on a daily basis. Rather, verified and consistent data should be saved in GUDe.
- In addition to these Terms of Use, the Guidelines for Ensuring Good Scientific Practice of the German Research Foundation (2019), the currently valid version of the Research Data Management Policy of Goethe University, and the Publication Agreement shall apply.
- A search in the repository can be performed without registration.
2. Registration, Admission and Termination¶
- For registration (registered user), members and associates of Goethe University must use their HRZ user account, cooperating scientists must use a federated login via the DFN-Verein via Shibboleth (hereafter Shibboleth) or their ORCID-iD.
- All registered users can link their account to ORCID and activate the sharing of metadata for published digital objects to their own ORCID profile.
- The submission of digital objects and data sets is only possible for members and associates of Goethe University on the basis of a publication agreement (rights holders).
- Members and associates of Goethe University can grant registered users access to their own unpublished digital objects.
- There is no entitlement to registration, an account or a profile (i.e. a dataset about one's own person). Goethe University is entitled to reject registrations or block accounts if there is a violation of these Terms of Use or if a legal obligation or official order to block access or other behavior gives reason to suspect that the registered user is not suitable for the use of GUDe or will continue to violate the Terms of Use or other legal obligations in the future.
- When registering, you agree to these terms of use by clicking on the corresponding checkbox and take note of the data protection information. This creates a user relationship between Goethe University and you as a registered user.
- During registration, your data will be transferred to GUDe in accordance with the privacy information of the identity provider used. You are obliged to protect your access identifiers from unauthorized access by third parties. The information in your personal profile must be filled in truthfully.
- Goethe University will delete accounts and all personal data of their profile immediately upon request in text form via the contact form without unnecessary delay. Accounts of registered users who use GUDe (1) via their HRZ login will be automatically deleted after three months after leaving the University; (2) via Shibboleth will be automatically deleted after one year of inactivity; (3) via their ORCID-iD will not be automatically deleted.
- Submissions made before deletion of an account remain published as long as Goethe University does not delete them or the registered user does not request deletion. In case of deletion, the metadata of the digital object will be preserved for the perpetual citability of the research data in GUDe.
- Registered users can voluntarily create a new account based on their ORCID-iD before the automatic deletion of their institution-bound accounts and transfer the already claimed reading rights to this account.
3. Use of the Repository¶
- The use of the repository is free of charge. Goethe University reserves the right to charge for use in the future.
- Any person may view published digital objects in the repository and use them according to the respective applicable license terms.
- In order to create digital objects, users must upload their research data to GUDe and add metadata. The digital objects receive persistent identifiers (e.g. a DOI) in the event of publication.
- According to the provisions of the publication agreement, GUDe is granted a simple right of use. The rights holder is thus still unrestrictedly free to publish their digital data and research results elsewhere in print or electronically before or after publication, if necessary modified or in excerpts.
- The release of digital objects and datasets is based on standards and recommendations (documentation standards) that are established together with the departments.
- It is possible to impose an embargo on the digital objects submitted for publication. If the digital object has already been published elsewhere and exclusive rights of use have been transferred in the process, the possibility of parallel publication in GUDe must first be checked.
- After submission, the added metadata can no longer be deleted, withdrawn, corrected or changed by the rights holder. For incorrect submissions, however, it is possible to request a correction for some of the metadata. This will be treated as a new submission.
- The submitted digital objects are stored for at least ten years. No warranty is given beyond this period and Goethe University is entitled but not obliged to delete digital objects after the ten-year period. However, the University will endeavor to retain the digital objects beyond the above period. In the event of deletion, the metadata of the digital object will be retained for the perpetual citation of the research data in GUDe.
- Digital objects submitted to GUDe must be published by the rights holder with license conditions. This license must be selected from a predefined list when the data is published. The metadata of the digital objects and data sets are always made available under a CC0 1.0 license.
- The registered user is responsible for the digital objects stored, published or made available by her*him in GUDe. Accordingly, she*he shall indemnify Goethe University against all claims asserted against Goethe University due to an infringement of rights and shall bear the costs of a reasonable legal defense of Goethe University. This shall not apply if the registered user is not responsible for the infringement. Registered users are obliged to provide Goethe University truthfully and completely and without delay with all information required for the review of claims and a defense in the event of a claim being made against Goethe University.
4. Service and Technology¶
- Digital objects are usually submitted to GUDe via the upload form provided on the repository website or via an automatable interface (API). The metadata is provided by the rights holders and checked by editors appointed by the UB and HRZ in consultation with the faculties.
- The metadata is freely available on the Internet and can be stored, offered and retrieved via the available open interfaces. This means that the publications from GUDe can be traced and found via national and international library catalogs and search engines. The operation and further development of GUDe is based on recommendations and standardizations of the professional community.
5. Rights and Obligations of Goethe University¶
- Goethe University endeavors for continuous availability of GUDe and, in the event of possible system failures, to remedy errors as quickly as possible. Maintenance-related system outages will be announced by the HRZ in good time. Goethe University provides for the necessary data security, data protection as well as the protection of data through regular backups. GUDe is operated on the basis of the DSpace-CRIS software, which is documented at https://wiki.lyrasis.org/display/DSPACECRIS.
- Nevertheless, Goethe University assumes no liability that the service and its content will always be available uninterrupted, unchanged and complete, or that it is up-to-date and free of errors of an editorial or technical nature. No liability is accepted for damage caused by reliance on the content of the platform or its use. Goethe University cannot be held responsible for loss or damage to digital objects.
- Goethe University does not assume any warranty or liability for the correctness, up-to-dateness and reliability of the research data provided by the rights holders and any further datasets stored in addition, except in the case of mandatory legal liability. In particular, Goethe University does not check the actual legal situation, especially with regard to protectability and rights ownership.
- Goethe University reserves the right to refuse or block access to digital objects due to content-related, technical or formal deficiencies, in the event of an actual or alleged legal impediment, as well as due to infringement of third-party rights or of provisions of these Terms of Use and/or the publication contract.
- No liability is assumed for damages resulting from the unauthorized use of password-protected logins by third parties.
- Insofar as liability is limited or excluded, this shall also apply in favor of executive employees (m/f/d), representatives (m/f/d) and vicarious agents (m/f/d) of Goethe University.
- Goethe University reserves the right to change the functionality, software and architecture, the appearance, and these Terms of Use at any time. If the terms of use are updated, registered users will be asked to agree again (by clicking the appropriate checkbox) the next time they log in. Further use of GUDe is only possible after consent has been given.
- Goethe University only sifts through, checks and monitors the digital objects stored and published on the repository for obviously illegal content. There is no examination of the actual legal situation, in particular with regard to protectability and rights ownership. Goethe University does not research on its own initiative circumstances that indicate illegal activities.
- Goethe University is entitled to discontinue GUDe at any time.
6. Severability Clause¶
Should one or more provisions of these Terms of Use be or become invalid, this shall not affect the validity of the remaining provisions of these Terms of Use. The invalid provision shall then be replaced by another legally permissible provision that corresponds as far as possible to the meaning and purpose of the invalid provision.

- Goethe University does not assume any warranty or liability for the accuracy, timeliness and reliability of the research data provided by the rights holders and any further datasets stored in addition, except in the case of mandatory legal liability. - The use of GUDe and the download of digital objects and datasets is currently free of charge.

2. Scope of data processing and legal basis¶
As a matter of principle, we collect and use personal data of our users only to the extent that this is necessary for the provision of a functional website and our content and services in GUDe.
The processing of data by the Johann Wolfgang Goethe-University Frankfurt (Goethe-University) is based on the data protection regulations, in particular the General Data Protection Regulation (in short: DSGVO), the Federal Data Protection Act (in short: BDSG) and the Hessian Data Protection and Freedom of Information Act (in short: HDSIG) in their respective applicable versions. In addition, the processing is based on the statutory task of cultivation and developing the sciences and arts (Section 3 (1) HHG) and maintaining the historical heritage (Section 6 (2) No. 1 HHG).
When processing personal data that is necessary for the performance of a contract to which you as the data subject are a party, Art. 6 (1) lit. b DSGVO serves as the legal basis. This also applies to processing operations that are necessary for the implementation of pre-contractual measures.
Insofar as the processing of personal data is necessary for the fulfillment of a legal obligation to which we are subject as a university, Art. 6 (1) lit. c DSGVO serves as the legal basis.
If the processing is necessary to protect a legitimate interest of our university or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 (1) lit. f DSGVO serves as the legal basis for the processing.
3. Processing of the data¶
The purpose of the institutional repository of Goethe University is the long-term and reliable storage and * if desired * publication of research data of members and staff of Goethe University as well as of cooperating scientists in the sense of the legal task of the cultivation and development of the sciences and arts (§ 3 para. 1 HHG) and the maintenance of the historical heritage (§ 6 para. 2 no. 1 HHG). The storage of research data containing personal or sensitive data is prohibited in GUDe.
In the following, research data with the accompanying metadata are referred to as digital objects, and public datasets without research data are referred to as datasets (for example, for projects, institutions, and individuals). If both digital objects and data sets are meant, the term submissions is used.
3.1 Personal data¶
According to Article 4 GDPR, 'personal data' means any information relating to an identified or identifiable natural person [...]; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. In GUDe, the personal data described as follows are collected, stored and/or processed.
3.2 Data for the technical delivery of the website¶
In order for the web application to deliver the web page to the user's computer or web browser, temporary processing of the full IP address by the web server and the downstream web applications is necessary for technical reasons.
3.3 Non-authenticated use of the web application¶
For non-authenticated users, the web application generally does not collect and process any personal data beyond the temporary processing of the full IP address.
3.4 Authenticated use of the web application using personal accounts¶
Depending on the usage scenario (governed by the terms of use) and the institutional affiliation of the users, different identity providers are available for the authenticated use of the web application, currently the HRZ of Goethe University, the federated login via the DFN-Verein via Shibboleth (hereinafter referred to as Shibboleth) or the non-profit organization ORCID. Depending on the identity provider, the following personal data is usually collected and processed during registration according to GUDe:
- Name of the user
- the selected identity provider (if applicable the name of the home organization)
- e-mail address stored with the identity provider
- Internal identifiers: UID or ORCID-iD
- user name and/or user ID
- Password and/or session cookies (tokens)
- Belongings to roles, groups, collections and digital objects and data sets in GUDe
Local accounts are set up * usually for a limited time * to carry out administrative and internal activities. Here, only the e-mail address, user name and/or user ID, and a password and/or session cookies (tokens) of the users are recorded.
The identity providers offered set their own rules for the collection, processing and transmission of personal data or are based on the express consent of the users. Among others, these are:
- For members and staff of Goethe University, these include HHG, HImV, Tariff Law, Civil Service Law, Personnel Law and DSGVO.
- For authentication via Shibboleth, the legal provisions of the respective home organization apply.
- For registration via ORCID, consent to the data protection regulations of the ORCID non-profit organization is a prerequisite.
The following time limits apply to the automatic deletion of accounts in GUDe based on the identity provider used in each case: * for HRZ accounts: three months after leaving Goethe University * for Shibboleth users: after one year of inactivity
Accounts created via ORCID are not automatically deleted. In addition, users of the other two identity providers can voluntarily transfer already claimed reading rights for digital objects to a new account based on an ORCID-iD before their accounts are automatically deleted. This allows permanent access to their own digital objects and serves good scientific practice.
Accounts (based on all identity providers) can be deleted at the request of the user (contact form of GUDe) - taking into account the publication agreement and the terms of use. The access to unpublished digital objects, which were assigned to this account, ceases with it.
On a voluntary basis, users can subscribe to a list of newly submitted digital objects in form of an email subscription (daily, weekly or monthly). This function can be deactivated at any time.
3.5 Publication data¶
After the initial registration, a linkable data record on the person (personal dataset) is also created in GUDe from the personal data transmitted for authentication. This consists solely of:
- Given and family name
and can be provided on a voluntary basis with:
- Unique author identifiers (e.g. ORCID-iD, GND).
- Links to records of institutions and projects
by the user him/herself.
This personal data set can be completely deleted and also (re-)created by the user. After deactivation of the account, this personal data set can also be later deleted upon request via the contact form of GUDe. However, the absence of a personal data set impairs the usability of GUDe by reducing the findability and interconnectivity of submissions.
In submissions created and published by users, the following personal data is typically stored, processed and, if applicable, published:
- Given and family name, title, and roles (e.g., author, editor).
- Unique author identifiers (e.g. ORCID-iD, GND)
- Information on organizational affiliation and official contact details (e.g. university, faculty, institute)
These data serve to clearly prove and acknowledge authorship and scientific achievement, as well as to make the submissions citable and easier to find. Users ensure that their own data and the data of any persons involved may be published worldwide.
Upon publication of the submissions, the University transfers and provides this personal data to third parties through interfaces as follows:
- to the German National Library within the scope of reporting obligations for the purpose of archiving and proof in the German National Bibliography
- to the registration agency DataCite for the unique assignment of permanent identifiers for publications (DOI)
- to scientific and general search engines such as Google, Google Scholar, BASE, etc.
- to third parties and crawlers worldwide, via standardized interfaces such as OAI (Open Archives Initiative)
Publication, and thus distribution and worldwide accessibility, will only take place with the consent of the publication agreement and the terms of use.
On a voluntary basis, GUDe also offers the possibility to synchronize the metadata of the submitted digital objects, in which the user is involved in any role, with their own ORCID profile. In the course of the corresponding authorization, personalized tokens (access & refresh) and permissions (granted scope) are exchanged between GUDe and the ORCID website. This opens up the possibility for the user to present their submissions in GUDe also on the pages of ORCID in the form of a personal bibliography.
3.6 Contact form¶
If you send us inquiries via the contact form, your data from the inquiry form including the contact data you provided there will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent.
The processing of this data is based on Art. 6 (1) lit. b DSGVO, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of requests addressed to us (Art. 6 (1) (f) DSGVO).
The data you enter in the contact form will remain with us until you request its deletion or the purpose for storing the data no longer applies (e.g. after processing your request has been completed). Mandatory legal provisions - in particular retention periods - remain unaffected.
3.7 Cookies¶
The website and application of GUDe uses cookies. A so-called cookie is a text fragment that the website places on the requestor's computer via the web browser and whose content is transmitted to the website again each time the web browser accesses it.
Temporary cookies are set for purposes that are purely limited to the functionality of the web application and do not allow the user to be identified across applications.
In particular, this includes the following purposes:
- Authentication of the current web session of the user towards the web application (token)
- Authentication of the current web session of the user's central identity provider towards the web application.
- Storage for application-specific settings, e.g., language selected by the user, session runtime, etc.
These purposes also constitute the legitimate interest of Goethe University in processing the personal data pursuant to Art. 6 (1) lit. f DSGVO.
The user data collected through technically necessary cookies are not used to create user profiles.
Cookies are stored on the user's computer and transmitted from it to the GUDe website. Therefore, you as a user also have full control over the use of cookies. The storage of cookies can be disabled in the web browser used. In this case, no cookies will be stored. As a result, however, no personal functions of the website can be executed (see above).
3.8 Logged data in the web server¶
When you access the website, the following personal data is stored in the form of access logs of the web server:
- IP address
- Access date/time
- access method
- access success
- accessed resource
- transferred data volume
- Web browser name
In the access logs created by the web server, the IP address of the users is usually processed anonymously and stored for a period of 14 full days. This data is used solely for the purpose of improving GUDe and monitoring the correct functioning of the service and error tracking. In order to resolve technical incidents, the above-mentioned data may be kept for a longer period of time. They will then be deleted immediately after the fault has been resolved.
In order to fend off an ongoing or imminent intentional attack on the website and to preserve evidence, Goethe University reserves the right to temporarily deactivate the anonymization of the IP address in the log files.
3.9 Logged data in the web application¶
When you access the website, the following data is permanently stored in the form of access logs of the web application after authentication for the purpose of scientific traceability and reusability:
- Login
- User name
- IP address
- Actions performed (e.g., submitting, editing, sharing, or publishing Digital Objects and non-research datasets)
- Access rights to areas, collections and individual digital objects
GUDe is divided into different communities and collections based on a simplified organizational structure of Goethe University. Users can store digital objects in these areas with different read and write permissions. Upon submission, the user is shown the current settings for write and read permissions (groups and, if applicable, individual users) for the selected collection.
3.10 Logged data for statistical evaluation¶
For the presentation of general usage statistics and the optimization of internal processes, GUDe collects the following non-personal data * without assignment to specific users * permanently in aggregated form: * The number of views and downloads (also of parts) of submissions * Terms in the various search dialogs * Workflow statistics (e.g., number of review processes, number of accepted and rejected submissions, etc.) * IP address location (obtained from local database)
For location detection, an internal database is used (ip ranges vs locations) In the course of this, the IP address is discarded after cross-referencing and is not saved in the access protocols generated by the web application.
3.11 No automated decision making¶
A processing of your personal data for the purpose of automated decision making (including profiling) pursuant to Art. 22 (1) DSGVO does not take place.
The collection of this data is based on Art. 6 para. 1 lit. f DSGVO. Goethe-University as the operator of the repository has a legitimate interest in the technically error-free presentation and usability as well as the optimization of the web application * for this purpose, the data mentioned in the section Processing of data must be collected.
4. Storage duration¶
Unless a more specific storage period has been specified within this data protection information, your personal data will remain in GUDe until the purpose for the data processing no longer applies. If you assert a legitimate request for deletion or revoke consent for data processing, your data will be deleted unless Goethe-Universtiy has other legally permissible reasons for storing your personal data (e.g. retention periods under tax law); in the latter case, deletion will take place after these reasons cease to apply.
5. Location of processing and storage¶
The web application of GUDe and the data processed in the web application are processed and stored by ourselves in Frankfurt a.M. in the state of Hesse in the Federal Republic of Germany.
6. Data security¶
Unfortunately, the transmission of information over the Internet is never 100% secure, so we cannot guarantee the security of data transmitted over the Internet to our website.
However, we secure our website by technical and organizational measures against loss, destruction, access, modification or distribution of your data by unauthorized persons.
In particular, your personal data is transmitted encrypted when you access this website. We use the SSL/TLS (Secure Sockets Layer/Transport Layer Security) coding system for this. Our security measures are continuously improved in line with technological developments.
7. Links to websites of other providers¶
The websites of GUDe may contain references ('links') to websites of other providers. Goethe-University has no influence on the data processing procedures and the possibilities of exercising rights on the linked website. However, to the extent that we place external links on our website, we have checked them to the best of our knowledge and belief at the time they were provided. The respective provider or operator of the sites is always responsible for the content of the linked sites. For details, please contact the provider of the relevant website (including the data protection statement available there). If we become aware of any legal violations, we will remove such links immediately.
8. Sharing your data¶
The data stored when you access the website will generally not be shared with third parties, unless it is specifically intended to be shared. Please note that we may be obliged by law or by a court decision to disclose it, or that this may be necessary for legal or criminal prosecution in the event of an attack on the website.
9. Your rights¶
As a user of the website, you have various rights in accordance with the DSGVO and the HDSIG with regard to your stored personal data:

- Right to restriction of processing (Article 18),
- Right to data portability, in a common, structured and machine-readable form (Article 20),

Insofar as data processing is based on your consent, you have the right to revoke your consent in whole or in part at any time without giving reasons. You can declare this revocation informally to Goethe-University. The legitimacy of the previous processing of your personal data remains unaffected by your revocation.
If you believe that Goethe University has not complied with data protection regulations when processing your data, you can file a complaint with the Goethe University's official data protection officer or with the supervisory authority for public bodies processing data in the state of Hesse to have it reviewed.
